1. Acceptance of terms

By accessing or using CaseWorthNow (the "Site"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not use the Site.

2. Informational purpose only; not legal advice

The Site provides informational content about U.S. personal-injury law. The Site does not provide legal advice. Use of the Site does not create an attorney-client relationship between you and the Site operator or any contributor to the Site. For advice on a specific legal matter, consult an attorney licensed in your jurisdiction.

Outputs from the AI-assisted tools on the Site are produced by machine-learning models and deterministic algorithms. They are informational and should never be relied on without independent verification against the cited sources and consultation with a licensed attorney.

3. Eligibility

You must be at least 18 years of age to use the Site. By using the Site, you represent that you are at least 18 and have the legal capacity to enter into these Terms.

4. Acceptable use

You agree to use the Site only for lawful purposes. You agree not to:

  • Use the Site in violation of any applicable law or regulation.
  • Use the Site to harass, threaten, or defraud any person.
  • Scrape, mirror, or otherwise systematically extract content from the Site without our written permission, except for fair use and as expressly permitted by the Site\'s robots.txt and rate-limit policies.
  • Reverse-engineer, decompile, or attempt to extract source code from the Site or its tools.
  • Bypass rate limits, authentication mechanisms, or other technical access controls.
  • Submit fraudulent content to the Settlement Tracker tool or any other user-submission feature.

5. Intellectual property

The Site, its design, code, content, and AI-tool outputs are protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, the Site operator grants you a limited, revocable, non-exclusive license to access and use the Site for personal, non-commercial informational purposes.

You may quote brief portions of the Site\'s editorial content under standard fair-use principles, with attribution and a link back to the source page. You may not republish full articles, copy the AI-tool methodologies, or use Site content to train a competing AI model without written permission.

Statutory text, case captions, and other primary-source material cited on the Site are in the public domain (federal works) or governed by state public-records laws.

6. User submissions

When you submit content to the Site (e.g., a settlement record through the Settlement Tracker), you grant the Site operator a perpetual, royalty-free, worldwide license to use, anonymize, aggregate, and publish the submission. You represent that the submission is accurate, that it does not violate any third party\'s rights (including attorney-client privilege and confidentiality agreements), and that you have the authority to make the submission.

7. Third-party content and links

The Site links to third-party content (statutes, court records, secondary authorities). The Site operator is not responsible for the accuracy, availability, or content of third-party resources. Third-party links are provided for convenience only.

8. Disclaimers of warranty

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." THE SITE OPERATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE SITE OPERATOR DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE SITE OPERATOR DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CONTENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE OPERATOR AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, WHETHER IN CONTRACT, TORT, OR OTHERWISE.

THE SITE OPERATOR\'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE IS LIMITED TO THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU HAVE PAID THE SITE OPERATOR IN THE 12 MONTHS PRECEDING THE CLAIM (WHICH IS USUALLY ZERO, BECAUSE THE SITE IS FREE TO USE).

10. Indemnification

You agree to indemnify and hold harmless the Site operator and its affiliates from any claims, damages, or expenses arising out of your use of the Site, your violation of these Terms, or your violation of any third-party rights.

11. Dispute resolution

Any dispute arising out of or related to these Terms or your use of the Site shall be governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any action to enforce these Terms shall be brought exclusively in the state or federal courts located in Delaware.

The Federal Arbitration Act applies to these Terms. You and the Site operator agree to resolve any dispute through binding arbitration on an individual basis, except that either party may bring an action in small-claims court for any claim qualifying for that court\'s jurisdiction.

12. Modifications

The Site operator may modify these Terms at any time. Material changes are effective upon posting to this page, and the effective date is updated at the top of the page. Continued use of the Site after a material modification constitutes acceptance of the modified Terms.

13. Termination

The Site operator may terminate or suspend your access to the Site at any time, for any reason, including for violation of these Terms. Upon termination, the provisions of these Terms that by their nature should survive termination will survive.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

15. Entire agreement

These Terms, together with the Privacy Policy and Editorial Policy, constitute the entire agreement between you and the Site operator regarding your use of the Site.
